By accessing or using the Medovyx platform, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and Medovyx ("Medovyx", "we", "us", or "our").
Medovyx provides a digital safety and care platform designed for elderly individuals and their caregivers. Our Services include:
You must be at least 13 years of age to use our Services. If you are under 18, you must have parental or caregiver consent. By using our Services, you represent and warrant that you meet these eligibility requirements.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at info@medovyx.com of any unauthorized use of your account.
Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions is prohibited.
Elder users are responsible for keeping their device charged and accessible, ensuring their emergency contacts are up to date, and using the SOS feature only in genuine emergency situations.
Volunteer and Caregiver users agree to respond promptly to emergency alerts, maintain confidentiality of elder users' personal information, and act in the best interest of the elders they are assigned to support.
IMPORTANT: Medovyx is a supplementary safety tool and is NOT a replacement for official emergency services. In any life-threatening situation, always call your local emergency number (112 in India) first.
Medovyx does not guarantee response times and cannot be held liable for delays in emergency response. The platform depends on internet connectivity and device functionality, which may not always be available.
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
You agree not to use our Services to:
To the maximum extent permitted by applicable law, Medovyx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of life, personal injury, or property damage arising from your use of our Services.
Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we deem harmful to other users or the platform.
